Terms of Use

These Terms of Use govern your use of the Abyss website and the Abyss iOS application (together, the "Service"). By accessing or using the Service, you agree to these Terms.

1. The Service

Abyss is a digital dive logbook designed to help recreational and technical divers record, organise and review their dives. The Service is provided on an "as is" and "as available" basis.

2. No substitute for training or a dive computer

Abyss is a logbook only. It is not a dive planner, decompression model, or dive computer. Any figures, summaries, calculations, or other information shown in the Service are provided for informational and record-keeping purposes only. They must not be relied upon to plan, conduct, or make decisions during any dive.

Diving is an inherently risky activity. You are solely responsible for your own safety, your dive planning, your adherence to your training, your equipment, and your use of a certified dive computer. Always follow the guidance of qualified instructors and established safe-diving practices.

You agree to use the Service only for its intended purpose and in compliance with applicable law. In particular, you must not:

You retain all rights to the dive data, notes, and media you create in the Service, unless applicable law provides otherwise. By default, Abyss stores such data locally on your device.

5. Intellectual property

The Abyss name, logo, design, text, graphics, and software, as well as the overall look and feel of the Service, are owned by the provider of the Service or licensed to the provider and are protected by applicable intellectual property and other laws. Nothing in these Terms grants you any right to use any name, logo, branding element, or other protected material of the Service without prior written permission.

6. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of liability

To the maximum extent permitted by law, the provider of the Service shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of profits, loss of use, or business interruption arising out of or in connection with the use of, or inability to use, the Service.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under applicable law.

8. Changes to the Service or these Terms

We may modify, update, suspend, or discontinue parts of the Service at any time. We may also update these Terms from time to time. Continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules, to the extent permitted by applicable law. If you are a consumer, mandatory consumer protection laws of your country of residence remain unaffected.
